1. Agreement to Terms

By downloading, accessing, or using the PuffBye mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Use License

PuffBye grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes to help you quit vaping. This license does not include:

• Modifying or copying the App materials
• Using the App for commercial purposes
• Attempting to reverse engineer any software in the App
• Removing any copyright or proprietary notations
• Transferring the App to another person or device without authorization

3. Medical Disclaimer

PuffBye is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The App provides tracking tools and motivational support but is not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding quitting vaping or nicotine cessation. Never disregard professional medical advice or delay seeking it because of information provided by the App.

4. User Accounts

You must create an account using Sign in with Apple to use PuffBye. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Providing accurate and complete information
• Updating your account information as needed

5. Account Deletion

You may delete your account at any time through the App settings. Upon deletion:

• All your data will be permanently removed from our systems
• Your data will be removed from your iCloud account
• You will lose access to all premium features (if subscribed)
• This action cannot be undone

6. Subscriptions and Payments

If you subscribe to PuffBye Premium:

• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• Refunds are handled according to Apple's App Store refund policies
• No refunds will be provided for unused portions of subscription periods

7. Prohibited Uses

You agree not to use the App to:

• Violate any laws or regulations
• Harm, harass, or impersonate others
• Distribute malware or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the App

8. Intellectual Property

The App and its original content, features, and functionality are owned by PuffBye and are protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, PuffBye shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the App.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Termination

We reserve the right to terminate or suspend your account immediately, without prior notice, if you breach these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
